Terms of Service — WeatherAI

WeatherAI Technologies LLC is a limited liability company organized under the laws of the State of California, United States ("WeatherAI," "we," "us," or "our"). These Terms of Service govern access to and use of the WeatherAI API, dashboard, documentation, and related services (collectively, the "Service") available at weather-ai.co.

1. Acceptance of Terms

By creating an account, generating an API key, or otherwise accessing the Service, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, in which case "you" refers to that entity.

If you do not agree to these Terms, you may not access or use the Service.

2. The Service

WeatherAI provides an API and related tools that deliver AI-processed weather intelligence, forecasting data, and related outputs to developers and businesses. We may add, modify, or discontinue features of the Service at any time, and we will make reasonable efforts to notify registered users of material changes that affect existing integrations.

The Service is provided on an "as available" basis and, unless a separate written Service Level Agreement has been executed between you and WeatherAI, we do not guarantee uninterrupted or error-free operation.

3. Accounts & API Keys

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account.

You must notify us immediately of any unauthorized use of your account or suspected key compromise.
API keys are non-transferable and may not be shared across unrelated accounts or resold as a standalone product.
We may suspend or rotate keys that we reasonably believe are compromised, without liability to you.

4. Fees & Payment

Certain tiers of the Service are offered free of charge, subject to usage limits described in our pricing page; paid tiers are billed in advance on a subscription or usage basis as described at checkout. Prices are quoted in USD unless a localized payment method presents an equivalent amount in local currency for convenience in certain supported markets.

Except where required by law, fees are non-refundable. We may change our pricing on a going-forward basis with at least 30 days' notice to active subscribers. Failure to pay amounts when due may result in suspension of API access until payment is resolved.

5. Acceptable Use

You agree not to, and not to permit any third party to:

Reverse engineer, decompile, or attempt to extract the underlying models or source code of the Service;
Use the Service to build a product that is substantially similar to and competitive with the Service;
Exceed rate limits through circumvention techniques, or interfere with the integrity or performance of the Service;
Use the Service for any unlawful purpose, or in a manner that infringes the rights of any third party;
Resell raw API access without a separate reseller agreement with WeatherAI;
Use the Service in life-safety-critical systems (e.g. aviation control, medical devices) without a separate written agreement addressing those risks.

We reserve the right to suspend accounts that violate this section pending investigation.

6. Intellectual Property

WeatherAI retains all right, title, and interest in and to the Service, including all underlying software, models, and documentation. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal or product-integration purposes.

You retain ownership of data you submit to the Service. You grant WeatherAI a license to process that data solely to provide and improve the Service, as further described in our Privacy Policy.

7. Data & Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. Where applicable law requires a data processing agreement (for example, for customers subject to the GDPR or other regional data protection laws), we will make one available on request.

8. Disclaimers

THE SERVICE, INCLUDING ALL FORECASTS AND AI-GENERATED OUTPUTS, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WEATHER FORECASTING INVOLVES INHERENT UNCERTAINTY; WEATHERAI DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY DATA PROVIDED THROUGH THE SERVICE, AND YOU ASSUME ALL RISK OF RELYING ON IT FOR OPERATIONAL OR SAFETY-RELATED DECISIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEATHERAI TECHNOLOGIES LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO WEATHERAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless WeatherAI Technologies LLC from and against any claims, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you breach these Terms, or for security, legal, or operational reasons, with notice where reasonably practicable. Sections that by their nature should survive termination (including Sections 6, 8, 9, 10, and 12) will survive.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email or through a notice on the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
